1. Who we are and these Terms
1.1 These Terms and Conditions (the Terms) govern keepofthedragon.com (the Website), Emberkeep: The Dragon Hatchery (the Game), player accounts (Accounts), the Ember Shop, Virtual Items and related support and functionality, together the Services.
1.2 The provider of the Services and your contractual counterparty is Lunqest LTD, registered at Companies House as LUNQEST LIMITED, a private limited company incorporated in England and Wales, company number 16823938, with its registered office at International House, 50 Essex Street, London, WC2R 3JF, United Kingdom. References to we, us and our mean Lunqest LTD. Contact us at support@keepofthedragon.com or by post at our registered office.
1.3 References to Emberkeep, Keep of the Dragon or EmberGames identify the Game, Website or branding. A studio or creative credit displayed in the Services does not replace Lunqest LTD as the provider under these Terms.
1.4 You accept these Terms when you actively agree to them during registration. A purchase also incorporates the product description and price displayed before you order and our Refund Policy. Our Privacy Policy and Cookie Policy explain information processing; agreeing to these Terms is not consent to optional tracking or marketing. Mandatory consumer rights prevail over all these documents. A specific purchase description prevails over a conflicting general description in these Terms, and the Refund Policy prevails on refund procedures and any more favourable refund entitlement.
1.5 The Account agreement continues until ended under these Terms. Each accepted purchase is a separate contract with Lunqest LTD. You may save or print these Terms and your purchase confirmation. Contracts are concluded in English unless we expressly offer another language, without limiting mandatory local language requirements.
2. Age and parental involvement
2.1 You must be at least 16 years old to create an Account or play the Game. If you are under 16, do not register, use another person's Account to play or submit personal information through the Services.
2.2 If you are under 18, or otherwise below the age at which you may independently enter this agreement under the law where you live, a parent or legal guardian must review and agree to these Terms and authorise your participation. Where local law requires the adult to contract on your behalf, that adult must do so. A statement of age does not override local rules on contractual capacity.
2.3 A player under 18 must not make a purchase independently. A parent or guardian must authorise each purchase and make or approve the payment using a payment method they are entitled to use. The same applies to an older player who still requires adult authorisation under local law.
2.4 Parents and guardians should supervise authorised play, protect payment credentials and discuss spending limits. They are responsible for payments they actually authorise, subject to applicable law. They do not automatically become liable for every action or unauthorised purchase merely because they are a player's parent or guardian.
2.5 Contact support if an underage Account or unauthorised minor's purchase comes to your attention. We will consider the circumstances and applicable law. We may restrict access while resolving eligibility or safeguarding concerns, using proportionate measures and preserving applicable refund rights.
3. Accounts and security
3.1 Use accurate registration information and keep your contact email current. An optional Keeper name need not be your legal name, but must not impersonate another person or infringe another person's rights. Where you choose an external sign-in option, its provider's terms govern that sign-in service; Lunqest LTD remains responsible for the Services it supplies.
3.2 Your Account is personal. Do not sell, rent, transfer or commercially share it, allow another person to impersonate you, or use multiple Accounts to obtain rewards or purchases fraudulently or evade restrictions. This does not prevent appropriate parental supervision.
3.3 Protect your credentials, sign out on shared devices and tell us promptly if you suspect unauthorised access or an incorrect purchase. We may request proportionate information to establish Account ownership. Never send support your password, security code or full payment-card details.
3.4 You are responsible for your own conduct and purchases you authorise. You are not automatically responsible for every action performed through a compromised Account. Responsibility for unauthorised activity depends on the facts and applicable law, including any failure by us to provide appropriate security.
4. Access licence and intellectual property
4.1 Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable licence to access and use the Services for your own non-commercial entertainment. It may be suspended or revoked only in accordance with these Terms and applicable law.
4.2 The Services' software, artwork, dragons and other characters, story, text, designs, music, logos, trademarks, databases and other materials belong to us or the relevant rights holders. Game systems and mechanics are protected only to the extent recognised by applicable intellectual property law. All rights not expressly granted are reserved.
4.3 You do not acquire ownership of the Game, its intellectual property or underlying files by playing or purchasing Virtual Items. This does not limit your contractual entitlement to the content and functionality promised to you or your statutory rights.
5. Free gameplay and Virtual Items
5.1 The core Game is free to play. It involves merging items, hatching dragons, harvesting resources, fulfilling Ledger orders and unlocking territory. Optional purchases primarily accelerate progression; payment is not required to play the core Game.
5.2 Virtual Items means Coins, Warmth, dragons, resources, boosters and other digital items, entitlements or functionality made available within the Game, whether earned or purchased. Paid Virtual Items are Virtual Items acquired for a real-money payment, including the paid element of a mixed bundle.
5.3 Virtual Items provide a limited contractual entitlement to use the relevant Game content or functionality. They are licensed for use, rather than sold as independently owned property. Coins and Warmth are in-game resources, not money, electronic money, cryptocurrency, financial instruments, stored-value products or redeemable cash balances.
5.4 Virtual Items have no cash-out or independently realisable monetary value. They cannot be redeemed for money or cryptocurrency, transferred between players, sold outside the Game or used to buy third-party goods or services. We do not operate an exchange or cash-out facility. A statutory refund repays a purchase price; it is not redemption of a cash balance. Nothing in this clause denies that a purchase has a real-money cost or reduces your consumer rights.
5.5 A resource may be used up through the action it enables. Merging can consume the items merged, and using Coins or Warmth can reduce the corresponding resource balance. Review the displayed cost and effect before confirming an action. Any purchase-specific quantity, duration, cap, activation condition or expiry must be disclosed before purchase. We will not impose a new expiry retrospectively on an existing Paid Virtual Item.
5.6 An item is for use in this Game and Account. Its purchase does not guarantee a particular achievement, continuing competitive advantage, future market value or unchanged gameplay indefinitely. Equally, crediting an item to your Account does not discharge all our obligations concerning its continuing conformity, accessibility or promised use.
5.7 We may correct an objectively identifiable error, such as an accidental duplicate grant or resources obtained through deliberate exploitation. Corrections must be proportionate to the error. Where possible, we will explain them and allow you to contest them. We will not use correction or balancing powers to arbitrarily confiscate legitimately acquired Paid Virtual Items.
6. Ember Shop purchases
6.1 The Ember Shop offers optional packs such as Pouch of Gold, Chest of Gold, Keeper's Coffer and Hearth Hoard. The live offer specifies the applicable quantity and price; examples or previous prices do not override the offer accepted for your purchase.
6.2 Before you order, review the item, quantity, destination Account, currency, total price including applicable taxes and unavoidable charges, technical requirements and delivery information. You can correct your selection before placing the order. We do not add undisclosed mandatory charges after you commit to pay. Your bank may impose its own currency-conversion charges under your agreement with it.
6.3 Selecting the final payment button submits your order with an obligation to pay the displayed total. We accept it when we send an acceptance confirmation or supply the purchase, whichever happens first. An automated acknowledgement expressly described as acknowledging receipt alone is not acceptance. We will provide the contract confirmation in a form you can retain, such as email, including relevant cancellation information.
6.4 Payment must be authorised by the payment-method holder. Payment providers may handle authorisation and settlement under their own payment-service terms and privacy notices. Using a provider does not remove our responsibility to supply your purchase or handle our consumer obligations.
6.5 Purchases are normally credited to the purchasing Account immediately or shortly after successful payment, subject to the cancellation arrangements in clause 7. Follow any displayed instruction to sign in or reload the Game so the Account can synchronise. Contact support if delivery fails; do not repeatedly reorder merely because the first order has not appeared.
6.6 We may decline an order before acceptance for a genuine payment failure, reasonable fraud concern, legal restriction or unavailable product. If we cannot supply an accepted order, we will inform you and provide the remedy required by law, including reimbursement where appropriate. An obvious pricing error does not allow us to charge a higher amount without your agreement.
6.7 If a payment fails or is reversed, we may investigate and temporarily restrict the disputed purchase. We may remove the corresponding unpaid entitlement where justified, but will not automatically penalise unrelated legitimate purchases. We will explain any amount genuinely owed and give a reasonable opportunity to dispute it. A good-faith refund request, bank dispute or statutory chargeback is not abuse.
6.8 These Terms do not authorise subscriptions, automatic top-ups or recurring payments. Such a product would require a separate, clear offer and the legally required agreement before charging you.
7. Cancellation and immediate supply
7.1 UK and EEA consumers generally have 14 days from conclusion of a qualifying distance contract to cancel without giving a reason, subject to the applicable exceptions. Missing required cancellation information can extend that period. The Refund Policy explains how to cancel and includes an optional cancellation form.
7.2 For a purchase legally qualifying as digital content supplied without a tangible medium, the change-of-mind cancellation right may end when supply begins only if the applicable legal requirements are met. Before immediate supply, we must obtain your separate express consent to start during the cancellation period and your express acknowledgement of the resulting loss of that right. We must also provide the required contract confirmation. Accepting these Terms or clicking a general purchase button alone is insufficient.
7.3 Unused purchased Coins remain eligible for cancellation within 14 days of the purchase contract. Merely crediting Coins does not remove that entitlement. We apply the same unused-resource cancellation treatment to purchased Warmth unless the offer clearly identifies a legally applicable digital-content treatment and the separate consent process in clause 7.2 has been completed. These protections apply to our UK and EEA customers, without limiting any more favourable legal right.
7.4 Spending a purchased resource on another item or function does not automatically waive rights relating to that later transaction. Any applicable digital-content exception must be validly applied to that transaction. The law governing the actual product prevails over its label in the Game.
7.5 If a paid supply is legally a service rather than digital content, merely starting it does not end the cancellation right. Any lawful charge for requested service supplied during the cancellation period must satisfy the applicable information and express-request requirements. Loss of the right through full performance requires the applicable consent and acknowledgement conditions. No cancellation charge arises for the free Account service.
7.6 Cancellation rules do not remove remedies for content that is defective, misdescribed or not delivered, duplicate or incorrect charges, or other statutory rights, even where content has been used.
8. Refunds and consumer remedies
8.1 Our Refund Policy forms part of each purchase contract. It distinguishes cancellation, non-delivery, defects, transaction errors, unauthorised purchases and discretionary refunds. We do not apply an unconditional “all sales are final” rule.
8.2 Where applicable, digital content must be of satisfactory quality, fit for a purpose made known and accepted, and as described; services must be supplied with reasonable care and skill. Applicable local conformity and update requirements also apply. Available remedies may include correction, repair, replacement, price reduction or termination and reimbursement, depending on the circumstances and applicable law.
8.3 Correctly performing content does not become defective solely because you change your mind about an informed gameplay choice. This does not determine whether you retain a separate cancellation right.
9. Updates, balancing and changes to the Game
9.1 We may update the Game to fix bugs, maintain security or compatibility, comply with law, prevent exploitation, improve accessibility or performance, or reasonably develop and balance gameplay. This may include adjustments to progression, resources, free features, events and, where a feature actually uses them, drop rates.
9.2 Changes must have a valid reason, be proportionate and respect the content description and reasonable expectations established when you purchased. We will not use this clause to impose additional charges for existing entitlements or remove a principal paid benefit without an appropriate remedy. Necessary conformity and security updates will be supplied for the period required by law.
9.3 We will explain material changes clearly. Where a change negatively affects access to or use of paid or otherwise legally protected content or services by more than a minor amount, we will provide reasonable advance notice in a durable form, such as email, explaining the change, its timing and your options.
9.4 For changes covered by applicable EEA digital-content modification rules, you may terminate the affected contract without charge within 30 days after receiving the notice or the change taking effect, whichever is later, unless we enable you to retain the unchanged, conforming content or service without additional cost. Applicable reimbursement rights follow. UK users retain their rights concerning unfair variations, breach of contract and non-conforming content.
9.5 Urgent security, legal or corrective action may require shorter notice. We will explain it as soon as reasonably practicable. Urgency does not extinguish a remedy otherwise due.
10. Prohibited conduct
10.1 You must not:
cheat, use bots, scripts or unauthorised automation, or alter saves or payment records to obtain an unauthorised benefit;
deliberately exploit bugs, duplicated transactions or errors instead of reporting them;
hack, introduce harmful code, bypass authentication or access another player's Account;
interfere with the Services, overload infrastructure, or conduct unauthorised scraping that extracts protected material, personal data or materially disrupts operation;
circumvent technical restrictions or use unauthorised software to manipulate the Game;
copy, commercially exploit, decompile or reverse engineer protected software, except to the extent applicable law permits and does not allow us to restrict;
trade Accounts or Virtual Items, arrange off-platform sales or claim an unauthorised resale right;
make fraudulent payments, falsely claim non-delivery or deliberately abuse refund or chargeback processes; or
use the Services unlawfully or infringe another person's rights.
10.2 Ordinary accessibility tools are not prohibited merely because they assist interaction. They must not be used to automate resource farming, bypass security or create unauthorised benefits. Contact support if you need an adjustment or are unsure whether a tool is compatible.
11. Suspension and termination
11.1 We may restrict, suspend or terminate access where reasonably necessary because of a material or repeated breach, cheating, fraud, unlawful activity, a genuine security risk or deliberate payment-system abuse. We will consider the seriousness, evidence, impact and whether a less restrictive response is sufficient.
11.2 Where reasonably possible, we will explain the reason, scope and expected next steps and allow a remediable breach to be corrected. Immediate restrictions may be necessary to prevent harm, comply with law or preserve security. We may withhold details where disclosure is unlawful or would undermine an investigation or security controls.
11.3 You may contest a decision at support@keepofthedragon.com. We will review the relevant facts and correct an erroneous restriction, including restoring legitimate entitlements where appropriate.
11.4 A suspension or termination does not automatically forfeit every Paid Virtual Item. We may reverse fraudulent or unpaid grants and deny access justified by a serious breach, but must address legitimate purchases proportionately and provide any refund or other remedy required by law. We will not impose a punitive forfeiture or charge unrelated to the breach.
11.5 You may end your Account agreement at any time by contacting support and asking to close your Account. Closure ends access to its progress and Virtual Items. Before permanent deletion we will explain material consequences and allow unresolved purchase claims to be raised. Voluntary closure does not itself create a refund right beyond this agreement or applicable law, and does not extinguish an existing claim.
11.6 If we discontinue the Game, or end your access for business reasons unrelated to your breach, we will give reasonable advance notice where practicable, stop selling content we cannot reasonably supply as promised and explain the treatment of outstanding purchases. We will reimburse unused paid resources and provide appropriate remedies for other affected paid entitlements, taking account of the original promise and applicable law. There is no automatic entitlement to recover the cost of content already properly enjoyed, but mandatory rights remain unaffected.
12. Availability, compatibility and saving
12.1 The Game is accessed through a compatible browser and internet connection on a supported desktop, phone or tablet. No separate Game installation is required. You remain responsible for your device, connection and ordinary network charges. We will disclose known material compatibility restrictions before purchase.
12.2 Maintenance, faults, third-party infrastructure problems and other interruptions may affect availability. We do not promise uninterrupted or entirely error-free operation. We will use reasonable care and skill to maintain the Services and address faults for which we are responsible.
12.3 Progress and purchases are associated with your Account. Successful synchronisation requires a working connection and the correct Account. Allow saving to complete before switching devices or clearing browser storage. These precautions do not excuse a failure by us to supply the saving functionality promised or remove remedies for lost paid content.
12.4 We may require a supported browser version or reasonable security update. Where a failure is caused solely by your not installing an update, any restriction on our liability applies only to the extent permitted by law, including applicable requirements to inform you about the update, its consequences and installation instructions.
13. Our responsibility for loss
13.1 We are responsible for loss or damage you suffer that is a foreseeable result of our breach of this agreement or failure to use reasonable care and skill. Loss is foreseeable where it is an obvious consequence or was reasonably contemplated by both parties when the relevant contract was made.
13.2 The Services are supplied for personal entertainment. We do not accept liability for business losses, including lost business profits, revenue, business opportunity or business interruption arising from commercial use contrary to these Terms. We are not responsible for loss that was not reasonably foreseeable or was caused by you or a third party without a breach or fault for which we are legally responsible.
13.3 We are not responsible for the portion of loss you could reasonably have avoided, including by following reasonable recovery or security instructions, subject to applicable law. You are not required to take unreasonable steps or incur disproportionate expense.
13.4 Where digital content we supply damages your device or other digital content because we failed to exercise reasonable care and skill, we will repair the damage or compensate you as required by law.
13.5 Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, statutory consumer remedies, liability under applicable data protection law that cannot be limited, or any other liability that cannot lawfully be excluded or limited. No general financial cap overrides these protections.
13.6 You are not required to indemnify us against all claims associated with your Account. Any claim we make for your own unlawful conduct or breach must satisfy ordinary applicable rules on liability, causation, foreseeability, mitigation and proof.
14. Changes to these Terms
14.1 We may amend these Terms for changes in law, security or technology, correction of errors, or reasonable changes to the Services described in clause 9. We will publish the revised version and its date.
14.2 For material changes affecting existing users, we will normally give at least 30 days' advance notice by email or another appropriate notice you can retain, explain the changes and obtain renewed agreement where legally required. A shorter period may be necessary for an urgent legal or security reason. Minor clarifications that do not adversely affect your rights may take effect on publication.
14.3 Changes do not retrospectively rewrite a completed purchase, remove accrued rights or authorise a change that would otherwise be unfair. If you do not agree to a material adverse change, you may end the affected agreement before it takes effect, with the remedies required by clauses 8, 9 and 11 and applicable law. Silence alone is not consent where express agreement is required.
15. Complaints, governing law and courts
15.1 Contact support@keepofthedragon.com with an Account or transaction reference and a short description of your concern. We will investigate and respond within a reasonable time. You do not have to complete an internal process before using a statutory remedy or going to court.
15.2 These Terms and purchase contracts are governed by the laws of England and Wales. If you are a consumer habitually resident elsewhere, this choice does not deprive you of mandatory protection afforded by laws applicable in your country of habitual residence.
15.3 The courts of England and Wales may hear disputes. Consumers in Scotland or Northern Ireland may also bring proceedings in their home courts. EEA consumers retain all mandatory rights to bring proceedings in their country of domicile or habitual residence, as applicable. We will bring proceedings against a consumer only in a court permitted by mandatory jurisdiction rules. There is no mandatory arbitration or class-action waiver.
15.4 Where applicable law requires us to identify a competent alternative dispute resolution body following an unresolved complaint, we will provide that information and say whether we are obliged or willing to participate.
16. General provisions
16.1 We may transfer this agreement with the relevant business to a successor capable of performing it, provided this does not reduce your contractual or statutory protections. We will notify you of a transfer materially affecting you. If it materially prejudices your position, you may end the affected agreement with any remedy required by law. You may not transfer your Account except with our agreement or as required by law.
16.2 If a provision is unenforceable, the remaining provisions continue where they can fairly operate independently. We will not rely on severance to rewrite an unfair provision against you. A failure to enforce a provision immediately does not waive later enforcement.
16.3 Nobody other than the parties has a contractual right to enforce these Terms, except where applicable law provides otherwise. Clauses necessary to resolve outstanding payments, refunds, liability or disputes survive termination to that extent.
